Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding agreement between you and SAMI AI (“SAMI OS,” “we,” “us”) governing your use of the SAMI OS platform, websites, and related services (together, the “Service”). By creating an account, starting a trial, or using the Service, you accept these Terms on behalf of yourself and any organization you represent.

2. The Service

SAMI OS is an AI-assisted operating system for real estate professionals. It can place and receive phone calls, send and receive text messages, qualify and route leads, run automations you approve, sync with third-party systems you connect, and produce summaries and analytics. AI-generated output can be imperfect; you are responsible for reviewing material communications and decisions.

3. Accounts and seats

  • You must provide accurate account information and keep credentials secure.
  • Plans are licensed per seat. Seats are for individual named users on your team and may not be shared.
  • You are responsible for all activity under your organization’s account.

4. Trials, billing, and credits

  • New accounts start with a 14-day free trial. You can cancel during the trial at no charge.
  • After the trial, plans bill monthly in advance at the then-current price for your plan and seat count.
  • Monthly SAMI credits power calling and texting; unused monthly credits do not roll over unless your plan or a purchased credit package says otherwise.
  • You can change plans or seat counts at any time; changes are prorated or scheduled per the in-app quote shown before you confirm.
  • Prices may change with at least 30 days’ notice, effective at your next billing cycle.

5. Telephone and messaging compliance

You direct the calls and messages SAMI sends on your behalf. You agree to use the Service only with leads and contacts you are permitted to contact, and to comply with all applicable communications laws and rules, including (in the U.S.) the TCPA, the Telemarketing Sales Rule, state telemarketing and call-recording laws, Do-Not-Call rules, and carrier A2P messaging policies. In particular, you agree to:

  • Obtain any required consent before calling or texting a contact, and keep records of that consent.
  • Honor opt-outs promptly (the Service processes standard stop keywords automatically).
  • Use truthful sender identification and complete any required brand and campaign registration we facilitate.
  • Not use the Service for spam, robocall abuse, or deceptive practices.

Calls made through the Service may be recorded and transcribed to provide summaries and quality features. You are responsible for ensuring any notice or consent required for recording in your jurisdictions is given.

6. Acceptable use

  • No unlawful, deceptive, or harmful use, and no interference with the Service.
  • No attempts to reverse engineer, resell, or scrape the Service except as allowed by law.
  • No uploading of content you lack rights to, or of sensitive data the Service is not designed to hold.

7. Your data

You retain ownership of the data you and your leads provide. You grant us the rights needed to operate the Service — including processing content through telephony, AI, and hosting subprocessors — as described in our Privacy Policy. You are responsible for having a lawful basis to share lead data with us.

8. Third-party services

If you connect third-party products (for example a CRM or Zapier), your use of those products is governed by their terms. We are not responsible for third-party services, and an interruption on their side may limit connected features.

9. Intellectual property

The Service, including software, design, and branding, is owned by SAMI AI and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your business during your subscription.

10. Disclaimers

The Service is provided “as is” and “as available.” We do not warrant uninterrupted operation, that AI output will be accurate or fit for a particular purpose, or that the Service satisfies your legal obligations. Nothing in the Service is legal advice.

11. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability under these Terms is limited to the amounts you paid us for the Service in the 12 months before the claim. These limits do not apply to your payment obligations, your compliance obligations in Section 5, or either party’s willful misconduct.

12. Termination

You may cancel at any time, effective at the end of your billing period. We may suspend or terminate the Service for material breach, non-payment, or use that risks harm to the Service, carriers, or recipients. Upon termination we will make your data available for export for a reasonable period as described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the app before it takes effect. Continued use after the effective date constitutes acceptance.
